ON
AMENDMENT TO DECREE OF THE MINISTER OF FINANCE NUMBER 135/KMK.05/2000 ON RELIEF OF IMPORT DUTY ON THE IMPORT OF MACHINES, GOODS AND MATERIALS IN THE FRAMEWORK OF THE DEVELOPMENT/EXPANSION OF INDUSTRY/SERVICE INDUSTRY.

Considering :

a. that in order to create a more conducive investment climate, it is necessary to amend the Decree of the Minister of Finance Number 135/KMK.05/2000;
b. that based on the considerations as meant in letter a, it is necessary to stipulate a Decree of the Minister of Finance on Amendment to Decree of the Minister of Finance Number 135/KMK.05/2000 concerning the Relief of Import Duty on the Import of Machines, Goods and Materials in the Framework of Development/Expansion Of Industry/Service Industry.

In view of :

1. Law No.10/1995 on Customs Affairs (Statute Book Of the Republic of Indonesia of 1995 No.75, Supplement to Statute Book Of the Republic of Indonesia No.3612);
2. Presidential Decree No.234/M/2000;
3. Decree of the Minister of Finance No.135/KMK.05/2000 on the Relief of Import Duty on the Import of Machines, Goods and Materials in the Framework of Development/Expansion Of Industry/Service Industry;

DECIDES:

To stipulate :

DECREE OF THE MINISTER OF FINANCE ON AMENDMENT TO DECREE OF THE MINISTER OF FINANCE NO.135/KMK.05/2000 ON THE RELIEF OF IMPORT DUTY ON THE IMPORT OF MACHINES, GOODS AND MATERIALS IN THE FRAMEWORK OF DEVELOPMENT/EXPANSION OF INDUSTRY/SERVICE INDUSTRY.

Article I

To amend provisions in Article 13 paragraph (1) of the Decree of the Minister of Finance No.135/KMK.05/2000, so as to read as follows:

"Article 13

(1) Companies already obtaining facilities of Exemption of import duty on the import of machines, goods and materials based on the old provisions and not yet realized their import wholly, may remain use Decree on customs facility granting based on the old provisions until the expiry of relevant Decree, provided that it can be extended and or amended to become facility of relief of import duty based on Decree of the Minister of Finance No.135/KMK.05/2000."

Article II

This Decree of the Minister of Finance shall come into force as from the date of stipulation and be retroactive since May 1, 2000.

For public cognizance, this Decree of the Minister of Finance shall be published by placing it in State Gazette of the Republic of Indonesia.
